COMMON ELEMENTS VS LIMITED ELEMENTS
Our Association Declaration clearly explains what is required and expected of both unit owners and the Association. When issues arise as to who is responsible for maintaining, repairing, replacing, or insuring an area within the community, the declaration control. The Association realizes there may be conflict or confusion as to who is responsible for those areas. When these conflicts arise, the Association will continue to have these documents reviewed by the Association attorney to advise on how to resolve these types of disputes.
It is the Declaration that defines the unit owner’s duty regarding repairing and replacing limited common elements, please refer to Section “Maintenance and Repair” Article 9 Section 2 page 8. Common Elements and Limited Common Elements are clearly defined in our Declaration, please refer to “Definition 7” page 1, “Definition 19” page 2, and “Common and Limited Common Elements” Article 6 Section 1-3 page 7.
